Hemma is operated by Hojae Jung (ABN 52 404 425 649) from Sydney, New South Wales, Australia. In these terms, “Hemma”, “we”, “us” and “our” mean Hojae Jung trading as Hemma, the operator of the myhemma.app service; “you” means the person or organisation using it.
By creating an account or using Hemma, you agree to these terms and to our Privacy Policy. If you’re using Hemma on behalf of a building, committee or organisation, you confirm you’re authorised to accept these terms for it. If you don’t agree, please don’t use Hemma.
You need to be at least 18 years old (or have the involvement of a parent, guardian or building manager) to use Hemma. Hemma is invitation-based — your building generally needs to be set up on Hemma, and you’ll usually join through an invitation from a building manager or committee.
When using Hemma, you agree not to:
You keep ownership of the content you post on Hemma. You give us a non-exclusive licence to host, store, display and share that content as needed to operate the service for you and your building. You’re responsible for the content you post and confirm you have the right to post it. We may remove content that breaches these terms or the law.
Hemma uses roles — resident, committee and building manager. Building managers and committees can manage their building’s content, settings and directory, including adding and removing members and switching features on or off. If you manage a building, you confirm you have the authority and any necessary consents to add residents’ details and to communicate with them through Hemma, and you agree to handle that information lawfully and only for the purposes of running the building.
Hemma is being rolled out building by building and parts of it are still in active development. We may add, change or remove features, and the service may occasionally be unavailable for maintenance or for reasons outside our control. We’ll try to give reasonable notice of significant changes, but during the pilot period some features are provided on an evolving basis.
Some plans or features may be free and others paid. Where fees apply, we’ll make the price and what it covers clear before you commit, and any paid terms will form part of this agreement. Unless stated otherwise, fees are in Australian dollars and may attract GST.
Hemma relies on third-party providers (such as our hosting, database and authentication providers) and may link to third-party content. We’re not responsible for third-party services, and your use of them may be subject to their own terms.
Hemma, including its name, brand, design and software, belongs to us and our licensors. These terms don’t give you any rights in our intellectual property other than the limited right to use the service as intended. Please don’t copy, modify or reverse-engineer the service except as the law allows.
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Among other things, services must be provided with due care and skill and be fit for purpose. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law where it would be unlawful to do so.
Where we’re permitted to limit our liability for a failure to comply with a consumer guarantee (other than guarantees that can’t be limited), our liability is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied.
Subject to section 12 and to the extent permitted by law: Hemma is provided “as is”; we don’t promise the service will be uninterrupted or error-free; and we’re not liable for indirect or consequential loss, or for loss of data, profit or goodwill. To the extent we are liable and the law allows us to cap it, our total liability to you is limited to the amount you paid us for the service in the 12 months before the claim (or, if you paid nothing, AUD $100).
You agree to use Hemma responsibly and to be responsible for content you post and for activity under your account.
You can stop using Hemma and close your account at any time. We may suspend or end your access if you breach these terms, if your building leaves Hemma, or if we need to for legal, security or operational reasons. Sections that by their nature should survive — such as content licences, intellectual property, liability and governing law — continue after termination.
We may update these terms from time to time. If we make a material change, we’ll update the date above and, where appropriate, let you know in the app. Continuing to use Hemma after a change means you accept the updated terms.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. Nothing in this section affects rights you have as a consumer under Australian law.
